Terms of Service

These terms are an agreement between you and Mobilina OÜ, registered in Estonia (“we”, “us”), about the game Gorilla Games on iOS, Android and the web (“the game”). By playing you accept them. If you do not accept them, do not play. Our privacy policy explains what we do with your data and is part of these terms.

The game creates a player account for you when it first runs, without asking for any details, and may let you link a Google or Apple sign-in to reach it from another device. You are responsible for the device the account is on. If you believe someone else has gained access to your account, contact us. We may suspend or close an account that is used to cheat, to attack the service, or to harm other players.

Gorilla Games is a general-audience game. You must be at least 13 years old, or the minimum age for using an online service without a parent's or guardian's consent where you live if that is older, to play. If you are old enough to play but not yet an adult where you live, playing means a parent or guardian has agreed to these terms on your behalf, where the law requires that.

• Coins are earned by playing. Gems are given out in small amounts for levelling up and winning, and may be bought with real money as gem packs.
• Coins, gems, gorillas, collections, weapons and any other virtual item are a limited, personal, non-transferable licence to use that item inside the game. You do not own them, they have no value outside the game, and they cannot be exchanged for money, sold, given away or moved between accounts.
• We may change what items exist, what they cost and what they do. We will not take back something you have paid for except as described under refunds below, or where an account is closed for breaking these terms.
• Prices are shown in the game before you buy. In the iOS and Android apps, gem packs are sold through the App Store or Google Play under their terms. On the web they are sold through Stripe, which acts as the reseller (merchant of record) for web purchases: it takes the payment on its own checkout page, charges any sales tax or VAT due, and issues your receipt, under its own terms shown at checkout. Web prices are set in US dollars and include tax; Stripe may show them in your local currency. Buying on the web needs a Google or Apple sign-in, so that what you buy is kept safe.
• Gems are delivered to your account as soon as the payment is confirmed. Because they are digital content supplied immediately, by completing a purchase you ask for them to be delivered at once and acknowledge that you then lose any right to withdraw from the purchase.

Refunds for gem packs bought in the apps are handled by Apple or Google under their own policies, and we honour their decisions. For gem packs bought on the web, contact osman@mobilina.co or Stripe's support from your receipt; a refund is paid back through Stripe to the card or wallet that paid. When a purchase is refunded, reversed or charged back, the gems it paid for are removed from your account, and if that leaves your balance below zero, the most recent items bought with gems are taken back until it is not. Items you earned or bought before that purchase are unaffected. A gem balance can therefore be negative for a time; it recovers as gems are earned or bought.

You can delete your account at any time from inside the game or from this website. Deletion is permanent. Every item, balance and record in the account is lost with it, including gems bought with real money that you had not yet spent, and nothing is refunded for them. Delete only when you are sure.

You may not modify the game, use a modified client, automate play, interfere with the servers or other players' matches, or claim rewards you did not earn. Doing so may lead to items being removed and the account being closed without refund.

The game's online features depend on our servers and on services we do not control. We try to keep them running but do not promise that the game will always be available, uninterrupted or free of errors. We may change or withdraw features, and we may stop offering the game altogether; if we do, we will say so in advance where we can. Virtual items are not refundable when a feature or the game is withdrawn, except where the law requires it.

The game, its art, sounds, code and names belong to Mobilina OÜ or its licensors. You may play it; you may not copy, distribute or make derivative works from it except where the law allows.

The game is provided as it is. To the extent the law allows, we are not liable for loss of virtual items, loss of progress, or any indirect loss arising from your use of the game, and our total liability to you is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, and nothing removes the rights you have as a consumer where you live.

These terms are governed by the law of Estonia. If you are a consumer in the European Union you also keep the protection of the mandatory rules of the country you live in, and you may bring a claim there. Disputes may also be taken to the EU online dispute resolution platform.

We may update these terms. The date at the top says when. Meaningful changes will be noted in the game's release notes, and continuing to play after a change means you accept it.

Oyun ilk çalıştığında sizin için, hiçbir bilgi istemeden bir oyuncu hesabı oluşturur ve bu hesaba başka bir cihazdan ulaşabilmeniz için Google veya Apple ile giriş bağlamanıza izin verebilir. Hesabın bulunduğu cihazdan siz sorumlusunuz. Hesabınıza başka birinin eriştiğini düşünüyorsanız bize ulaşın. Hile yapmak, hizmete saldırmak veya diğer oyunculara zarar vermek için kullanılan bir hesabı askıya alabilir veya kapatabiliriz.

Gorilla Games genel kitleye yönelik bir oyundur. Oynamak için en az 13 yaşında olmalısınız — yaşadığınız yerde çevrimiçi bir hizmeti ebeveyn izni olmadan kullanabilmek için daha yüksek bir asgari yaş öngörülüyorsa, o yaşta olmalısınız. Oynayacak yaşta ama yaşadığınız yerde henüz reşit değilseniz, oynamanız, kanunun gerektirdiği hâllerde bir ebeveyn veya vasinin bu koşulları sizin adınıza kabul ettiği anlamına gelir.

• Coin oynayarak kazanılır. Gem, seviye atlayınca ve kazanınca küçük miktarlarda verilir; ayrıca gerçek parayla gem paketi olarak satın alınabilir.
• Coin, gem, goriller, koleksiyonlar, silahlar ve diğer her sanal öğe, o öğeyi oyun içinde kullanmak için sınırlı, kişisel, devredilemez bir lisanstır. Bunlara sahip olmazsınız, oyun dışında hiçbir değerleri yoktur ve para karşılığı değiştirilemez, satılamaz, hediye edilemez veya hesaplar arasında taşınamaz.
• Hangi öğelerin var olduğunu, ne kadara mal olduklarını ve ne yaptıklarını değiştirebiliriz. Ödediğiniz bir şeyi, aşağıdaki iadeler bölümünde anlatılan durumlar veya bu koşulların ihlali nedeniyle hesabın kapatılması dışında geri almayız.
• Fiyatlar satın almadan önce oyunda gösterilir. iOS ve Android uygulamalarında gem paketleri App Store veya Google Play üzerinden, kendi koşulları altında satılır. Web'de ise, web satışları için satıcı sıfatıyla işlemi devralan Stripe üzerinden satılır: ödemeyi kendi ödeme sayfasında alır, varsa satış vergisini veya KDV'yi hesaplar ve makbuzunuzu, ödeme sırasında gösterilen kendi koşulları altında düzenler. Web fiyatları ABD doları cinsinden ve vergi dahil belirlenir; Stripe bunları yerel para biriminizde gösterebilir. Web'den satın almak bir Google veya Apple girişi gerektirir, böylece aldığınız güvende tutulur.
• Gemler, ödeme onaylanır onaylanmaz hesabınıza teslim edilir. Anında sunulan dijital içerik oldukları için, satın almayı tamamlayarak hemen teslim edilmelerini istemiş ve bu satın almadan cayma hakkınızı kaybettiğinizi kabul etmiş olursunuz.

Uygulamalarda satın alınan gem paketlerinin iadeleri Apple veya Google tarafından kendi politikaları altında yürütülür; kararlarına uyarız. Web'de satın alınan gem paketleri için osman@mobilina.co ile veya makbuzunuzdaki Stripe destek bağlantısıyla iletişime geçin; iade, ödemeyi yapan karta veya cüzdana Stripe üzerinden geri ödenir. Bir satın alma iade edildiğinde, geri alındığında veya itiraz edilip geri çekildiğinde, ödediği gemler hesabınızdan düşülür; bu, bakiyenizi sıfırın altına indirirse, sıfırın altına inmeyecek şekilde en son gemlerle alınan öğeler geri alınır. O satın almadan önce kazandığınız veya aldığınız öğeler etkilenmez. Gem bakiyesi bu yüzden bir süre negatif olabilir; gem kazanıldıkça veya satın alındıkça toparlanır.

Hesabınızı istediğiniz zaman oyunun içinden veya bu web sitesinden silebilirsiniz. Silme kalıcıdır. Hesaptaki her öğe, bakiye ve kayıt, harcamadığınız gerçek parayla alınmış gemler dahil, bununla birlikte kaybolur ve bunlar için hiçbir iade yapılmaz. Yalnızca emin olduğunuzda silin.

Oyunu değiştiremez, değiştirilmiş bir istemci kullanamaz, oynanışı otomatikleştiremez, sunuculara veya diğer oyuncuların maçlarına müdahale edemez veya hak etmediğiniz ödülleri talep edemezsiniz. Bunu yapmak, öğelerin kaldırılmasına ve hesabın iade yapılmadan kapatılmasına yol açabilir.

Oyunun çevrimiçi özellikleri sunucularımıza ve kontrolümüzde olmayan hizmetlere bağlıdır. Bunları çalışır tutmaya çalışırız ama oyunun her zaman kullanılabilir, kesintisiz veya hatasız olacağını taahhüt etmeyiz. Özellikleri değiştirebilir veya kaldırabiliriz, hatta oyunu tamamen sunmayı bırakabiliriz; bunu yaparsak, mümkün olduğunda önceden bildiririz. Bir özellik veya oyun kaldırıldığında, kanunun gerektirdiği durumlar dışında sanal öğeler için iade yapılmaz.

Oyun, sanatı, sesleri, kodu ve isimleri Mobilina OÜ'ye veya lisans verenlerine aittir. Oyunu oynayabilirsiniz; kanunun izin verdiği durumlar dışında kopyalayamaz, dağıtamaz veya ondan türev eserler oluşturamazsınız.

Oyun olduğu gibi sunulur. Kanunun izin verdiği ölçüde, sanal öğe kaybından, ilerleme kaybından veya oyunu kullanımınızdan doğan dolaylı bir kayıptan sorumlu değiliz; size karşı toplam sorumluluğumuz, talepten önceki on iki ay içinde bize ödediğiniz tutarla sınırlıdır. Bu koşullardaki hiçbir hüküm, kanunen sınırlandırılamayan bir sorumluluğu sınırlamaz ve yaşadığınız yerde tüketici olarak sahip olduğunuz hiçbir hakkı ortadan kaldırmaz.

Bu koşullar Estonya hukukuna tabidir. Avrupa Birliği'nde bir tüketiciyseniz, yaşadığınız ülkenin emredici kurallarının korumasını da korursunuz ve talebinizi orada da ileri sürebilirsiniz. Uyuşmazlıklar AB çevrimiçi uyuşmazlık çözüm platformuna da taşınabilir.

Bu koşulları güncelleyebiliriz. Üstteki tarih ne zaman olduğunu gösterir. Önemli değişiklikler oyunun sürüm notlarında da belirtilir; bir değişiklikten sonra oynamaya devam etmek, onu kabul ettiğiniz anlamına gelir.
